I need some advice - please. I have to submit my first round of guardianship papers and I'm having a very difficult time. I don't understand what they want. It's overwhelming while trying to deal with the everyday stuff with mom (69,middle stage alz.). She is becoming more nasty and aggressive with me. I feel like maybe someone else should be her guardian. Maybe that's why it's so hard to get started on the paperwork. If anyone knows of a website or has any suggestions, I would greatly appreciate it. Thanks.

Has guardianship been granted?? Are you asking about the yearly filing of financial things? Or are you looking to obtain guardianship through the courts?


Maybe the hokey pokey IS what it's all about!

Dear Marzip,

Do you have an attnorney? If so, your attn. ought to be going over what you need to know. If not, you may call the Probate Court and Adult Protective Services in your county. They may not be able to give you legal advice , however, they know the process/laws in your state.

I strongly do not recommend having another party being guardian for your Mom. Many times court appointed public guardians have many clients. I know of a case of a public guardian with over 150 "clients" and one of their "clients" was walking along I 75 in the Mid Mich area--- this summer with a winter coat on and it was in the 80's that day. Hi and thank you for your responses. I was granted legal guardinship last June so this is the first time I have to file paperwork. My lawyer is a bit lazy and just wants the papers done yesterday. I'm working on them but it's a lot to do. I really won't relinquish quardianship, I just feel desperate sometimes and don't know what to do. Thanks for any response. Peace.

marzip - I have 2 Down Syndrome daughters and obtained full guardianship (physical and financial) when they became 21. I had to file two financial reports annually.
The local court requires that I report on the physical condition and I used to have to report in great detail on the financial. A friend of mine who was a lawyer asked the court to waive the financial report since they had no assets, just social security.
However I was required to post a bond every year.Then last year when the cost of the bond went up I personally petitioned the judge to waive the bond since I had been taking care of them for so many years. (They are now 48 & 49). I now have a "personal cognizance" duty to report to the judge and the bond was waived.
Annually I have to file a report with the Social Security folks to tell them how I have used their Social Security funds. It is a simple form, provided by them, and as long as I show that I have spent every dime, there is no problem.

I would check with an attorney to find out what your responsibilities are as to reporting.
The local reports I used to file were very detailed, but that is in Texas. Your state may be totally different -- also your mother may have assets you will have to account for.

P.S. I use Quicken to keep track of my expenses and then divide by 3 since there are 3 of us in the house. Hope this helps.
